The study of speech acts has been a flourishing branch of the philosophy of language and linguistics over the last two decades, and John Searle has of course himself made some of the most notable contributions to that study in the sequence of books Speech Acts, Expression and Meaning and Intentionality. Expression and Meaning is a direct successor, concerned to develop and refine the account presented in Searle's earlier work, and to extend its application to other modes of discourse such as metaphor, fiction, reference, and indirect speech arts. Searle also presents a rational taxonomy of types of speech acts and explores the relation between the meanings of sentences and the contexts of their utterance. (...) The purpose of this article is to explain how an account of proper names can be incorporated into a general account of the intentionality of mind and language. I show that such an account supports the so-Called descriptivist conception of proper names and in so doing I answer the objections of causal theorists.

Given recent technological advances, we now are able to invade personal privacy as never before. The challenge in the business community is to make the most of the opportunities presented by the growth in communication technology while, at the same time, protecting what remains of individual privacy. The conflict between technological advances and privacy concerns is not new, but it has grown exponentially in recent years, and the development of a data protection scheme in the European Union lends a certain (...) economic urgency to meeting the challenge.Pursuant to a Directive adopted by the European Union, privacy protections throughout the EU must become more stringent and consistent throughout EU member countries. One area of great concern to the United States is the Directive's requirement for certain minimum standards of privacy protection in countries receiving information from member countries. Given the limited protections available in the United States, it does not appear that the United States meets these minimum standards. Potts Jr. (bio)In December 1997, the Institute of Medicine (IOM) released a report on medical and ethical issues in the procurement of non-heart-beating organ donors. This report had been requested in May 1997 by the Department of Health and Human Services (DHHS). We will here describe the genesis of the (...) IOM report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. NHBDs can also be “uncontrolled,” which means that their hearts and breathing have stopped through disease or injury at an unexpected time or in an uncontrolled manner, and they cannot be resuscitated; the organs of some individuals of this description can be recovered for transplantation. The IOM report focused on both controlled and uncontrolled NHBDs and on problems specific to them.The questions that were asked and addressed in the IOM report became current and salient beginning in 1992 with the establishment of the University of Pittsburgh “Policy for the Management of Terminally Ill Patients Who May Become Organ Donors After Death.” This policy addressed controlled NHBDs and the ethical questions raised by their use; much of the discussion was reported in the June 1993 special issue of the Kennedy Institute of Ethics Journal. Public notice and anxiety about some of these concerns were sharpened and refocused by national and local media allegations of improper treatment of donors at the Cleveland Clinic in 1997, specifically premature—i.e., antemortem—recovery of organs and administration of drugs that allegedly might hasten donor death.The DHHS Request for StudyIt is not surprising that several federal actions would be taken in response to these events. He was one of the most distinguished historians of philosophy of his generation. Early in his studies he had found Locke's Essay Concerning Human Understanding a challenging book that raised as many puzzles as it answered and it was his engagement with that work that dominated his intellectual enquires from his MA (...) studies until his latest book, published last year, The Two Intellectual Worlds of John Locke. Man, Person, and Spirits in the "Essay." It was his fifteenth authored book. His first book was his Oxford D. Phil. Thesis, John Locke and the Way of Ideas, published nearly fifty years ago in 1956. If Locke and Ideas were to dominate his writings, they were not exclusive of other interests. His second book was The Philosophy of A.S. Eddington. Others, not Locke-centered, were to follow. In later years he has focussed especially on the problem for all readers of Locke and other early modern philosophers including Descartes, Berkeley and Hume, as to the nature of their commitment to ideas. Did they really hold that ideas are objects that intervene between the perceiving mind and the outside world, or is the standard reification of ideas simply a mistaken reading of their argument? Yolton, since at least the early 1980s, has argued that to reify ideas in the standard way is based on a false reading of the texts. His reading has not always been accepted by historians of philosophy but there are signs that that might be changing and some books and articles published in the last five years or so reveal distinct signs of a Yolton influence.John Yolton was not only a prolific writer he was also a highly regarded editor, not only of Locke texts but also of important collections of papers such as John Locke: Problems and Perspectives (1969) and The Blackwell Companion to the Enlightenment (1992) to which he contributed [End Page 419] a prodigious number of entries. But perhaps as important as his writing was Yolton's teaching. Nobody who sat in on one of his classes could not but be impressed with the way in which he was able to hold a class's attention to a text of Descartes, Locke or Hume and engage first year or graduate students in a scrutiny of the text, perhaps only a paragraph or even a sentence long, teasing out its ambiguities and its place in an argument, to the obvious enlightenment of students who until then had found early modern philosophical prose dull and uncaptivating. It is no surprise to find that he supervised a large number of scholars of the early modern period who have gone on to make important contributions to the history of philosophy and intellectual history.John Yolton was always enormously generous with his time. His graduate students became extensions of the Yolton family. So also did younger scholars. Any book or paper sent him was always to receive careful attention and detailed comment, always fair but never patronising. He was also very active as a member of many editorial boards, including the Journal of the History of Ideas and the Clarendon Locke Board. John was appointed to the Board of Consulting Editors of the JHI in 1977. This book is a selection of papers from a conference which took place at the University of Keele in July 1982. The conference was an extraordinarily enjoyable one, and we would like to take this opportunity of thanking all participants for helping to make it so. The conference was intended to allow scholars working on different aspects of symbolic behaviour to compare findings, to look for common ground, and to identify differences between the various areas. We hope that it was (...) successful in these aims: the assiduous reader may judge for himself. Several themes emerged during the course of the conference. Some of these were: 1. There is a distinction to be made between those symbol systems which attempt, more or less directly, to represent a state of affairs in the world (e. g. language, drawing, map and navigational skill) and those in which the representational function is complemented, if not overshadowed, by properties of the symbol system itself, and the systematic inter-relations that symbols can have to one another (e. g. music, mathematics). The distinction is not absolute, for the nature of all symbolic skills is, in part, a function of the structure of the symbolic system employed. Nonetheless, this distinction helps us to understand some common acquisition difficulties, such as that experienced in mathematics, where mental manipulation of symbols can go awry if a child assumes too close a correspondence between mathematical symbols and the world they represent. 2. This work on the theory of education was first published in 1839. The five writers had been chosen as the winners in a competition for an essay on the 'Expediency and Means of Elevating the Profession of the Educator in Society', organised by the Central Society of Education, founded in 1837 to promote state funding of education, at a time when the 'monitor' system, whereby older children taught younger ones, was seen as an effective method. The journalist John Lalor (...) won first prize with a wide-ranging consideration of all the aspects of education, comparing the status of teachers through history and across several countries, and championing their 'sacred mission'. The runners-up were the writer John A. Heraud, the Unitarian minister Edward Higginson, the lawyer and author James Simpson, and Mrs Sarah Porter, prolific writer on education and sister of the political economist David Ricardo. (shrink)

The obligation of a court to follow the law of a superior court is commonly taken to be stronger than the obligation of the higher court to respect its own precedent. The Supreme Court has recently asserted this stronger obligation in the most forceful terms. What follows is an attempt to demonstrate that this is wrong as a matter of policy and as a matter of law.

Three hundred years after his major publications, John Locke remains one of the most potent philosophical influences in the world today. His epistemology has become embedded in our everyday presumptions about the world, and his political theory lies at the heart of the liberal democratic state. This article examines how scientists and regulators distribute the benefit of the doubt about drug safety under conditions of scientific uncertainty. The focus of the empirical research is the regulatory controversy over the hepatorenal toxicity of benoxaprofen in the United Kingdom and the United States. By scrutinizing the technical coherence of the arguments put forward by industrial and government scientists, it is concluded that these scientists are willing to award the commercial interests of the pharmaceutical industry an enormous benefit of (...) the sccentific doubt, which is not consistent with the best interests of patients. Interpretative flexibility, the burden of proof falling on regulators and their trust in, and dependence on, industrial scientists facilitates that distribution of the benefit of the scientific doubt. However, regulatory authorities' need for viability and the rationality common to opposing scientific views suggest that it is possible, in principle, to alter this dominant trend. To achieve adequate patient protection, drug regulation in the United Kingdom and the United States requires extensive reform. Some preliminary policy changes are sketched. (shrink)

Construal-level theory emphasizes that representing events at greater spatial, temporal, social, or hypothetical distance results in processing information at high construal levels (more conceptual, abstract). We posit that psychological distance and construal level are somewhat separable constructs, and can have different effects on emotion, and therefore, emotion regulation. We argue that psychological distance influences emotional appraisal, such that increasing distance results in lower emotion intensity, which can be leveraged to down-regulate emotions. However, we consider construal level a mindset, which can (...) occur with either high or low psychological distance. Furthermore, we argue that compared with psychological distance, construal level has a more nuanced relationship with emotion, and changing construal level for the purpose of changing emotion also requires considering the construal level of one's emotion-regulation goals.
